GENERAL TERMS AND CONDITIONS
Big Air Festival Chur

1. General regulations

  • The Big Air Festival is a festival organized by First Event AG, hereinafter referred to as the “organizer”.
  • By purchasing an admission ticket to the festival, the purchaser accepts these General Terms and Conditions. The holder of an admission ticket who has not purchased his admission ticket via the ticket provider designated by the organizer or who has otherwise become the holder of an admission ticket accepts these General Terms and Conditions at the moment he takes possession of the admission ticket.
  • The festival takes place outdoors in all weathers.
  • The instructions of the organizer’s staff must be strictly followed. Failure to do so will result in expulsion from the festival grounds without refund of the ticket price. The organizer reserves the right to take civil and criminal action.
  • The festival area consists of the following cordoned-off sections: Festival grounds and the festival parking lot. Access to the festival area or individual areas is only possible with a valid admission ticket at the access times published for the respective category on the organizer’s website.
  • The festival visitor agrees to being recorded as part of the audience before, during and after the festival in image, sound and video recordings. These recordings may be used and exploited commercially and without compensation by the organizer and/or third parties. He expressly and irrevocably waives the assertion of his personal rights in this regard..

 

2. Program

  • The organizer has no influence whatsoever on the design and content of the artists’ performances. The same applies to the Freeski and Snowboard World Cups organized by the FIS or Swiss-Ski. The organizer assumes no liability in this regard.

 

3. Noise immissions

  • There is a risk of possible damage to hearing and health at concerts due to the volume. Earplugs are provided at the entrances to and at special locations on the festival grounds.

 

4. Safety

  • The organizer’s security service will carry out security and admission checks at all official entrances to and along the festival site and for the entire duration of the festival.
  • The security service carries out random bag checks and body searches in consultation / cooperation with the local police authorities.

 

5. Access to and behavior in the festival area

5.1 Traffic

  • Parking on the access roads to the festival site and on the festival site (excluding festival parking lots) is strictly prohibited.
  • Vehicles parked on the access roads or not on the festival parking lot will be towed away without prior notice and at the owner’s expense. The vehicle owner is liable for costs and must bear all expenses as soon as the towing service has been ordered.
  • Vehicles are parked at your own risk.

 

5.2 Entrance

  • The admission ticket must be exchanged for a control wristband at the official cash desks and exchange stations of the organizer. The control wristband is personal and non-transferable.
  • Every person entering the festival area (excluding the festival parking lot) must wear the wristband firmly closed around the wrist before entering the festival area.
  • Damaged wristbands and wristbands not worn securely around the wrist do not entitle the holder to use the services of the organizer, in particular not to admission, and are invalid.
  • The control wristband entitles the holder to enter the festival area for the duration stated on the admission ticket.
  • Lost admission tickets, free tickets or wristbands will not be replaced.
  • Persons who remain on the festival grounds (excluding the festival parking lot) without a properly attached wristband will be turned away and reported.

 

5.3 Records

  • Image, sound, film and video recordings of the artists and athletes performing at the festival are not permitted. Recordings for private use are generally permitted.
  • The commercial use and exploitation of image, sound, film and video recordings of the artists and athletes performing at the festival, of festival visitors or of the festival infrastructure is prohibited.

 

5.4 Further rules

  • Prohibited objects and animals on the festival grounds are:
    • Parasols and umbrellas as well as (flag) poles
    • All firearms, spraying, stabbing, striking and slashing weapons as well as other objects classified as dangerous, in particular penknives (penknives)
    • Cameras with digital or analog SLR cameras with/without interchangeable lenses, film and video cameras and audio recording devices
    • Selfie and GoPro sticks etc.
    • Drones and other airworthy devices, with or without cameras
    • Rollerblades, skate and kickboards, skis, snowboards, snow and roller skates, bicycles, baby carriages, etc.
    • Glass
    • Pyrotechnic objects, petards, dry ice
    • Animals
  • A deposit of CHF 2.00 is charged on every drink purchased on the festival site. The deposit will be refunded at all bars and drinks stands. Organized collection of deposits by individuals or organizations – even under the guise of a “good cause” – is prohibited without prior consultation with the organizer. In the event of non-compliance, such persons will be expelled from the festival grounds without refund of the ticket price.
  • Overnight stays on the festival grounds are generally prohibited.
  • No fires are allowed to be lit on the festival grounds..

 

6. Tickets

Tickets can only be purchased from the ticket providers designated by the organizer.

6.1 No right to return or refund

  • Under no circumstances is there a right to return the admission ticket or a claim for reimbursement of the purchase price of the admission ticket.
  • In particular, festival visitors also acknowledge that changes may be made to the line-up and/or World Cup of the festival at any time, even at short notice, e.g. that artists’ performance times may be postponed or that an artist may not perform at all, that the start or end of the Freeski or Snowboard World Cup may be postponed, that a World Cup may not be held at all or may have to be canceled due to poor weather conditions or a race management decision, or that an athlete may not perform at all. These and similar circumstances also do not justify a right to return the entry ticket or a claim for reimbursement of the purchase price of the entry ticket.

6.2 Resale of tickets

  • The purchase of tickets for the purpose of resale is prohibited. The organizer will carry out appropriate checks and may block tickets purchased for the purpose of resale and declare them invalid. The organizer reserves the right to take civil and criminal action.

 

7. Liability

  • To the extent permitted by law, any liability of the organizer for its own conduct and for the conduct of its auxiliary persons is excluded. In particular, the organizer and its auxiliary persons are not liable for bodily injury or property damage caused to festival visitors by third parties (e.g. stand operators).

 

8. Final clauses

  • If the festival has to be canceled or postponed due to force majeure (e.g. war, death or illness of an artist or athlete, severe weather, catastrophes, unrest, terrorist threat, warning or act, official ban, non-approval of the festival through no fault of the festival, decision by the FIS, Swiss Ski and/or the race organizers not to hold one or more World Cups, etc.), there is no entitlement to a return of the ticket or a refund of the ticket price. If an event is canceled or postponed through no fault of the organizer, there is no right to a return of the ticket or a refund of the ticket price; the ticket can only be exchanged for a ticket for the next edition of the festival. In exceptional cases, the organizer may decide at its own discretion and on a case-by-case basis whether to refund the purchase price of the ticket instead, minus a handling fee of 10% of the purchase price (maximum handling fee CHF 50.00). There is no entitlement to a refund.
  • If the festival has to be interrupted or canceled due to force majeure, there is no entitlement to a return of the ticket, a refund of the ticket price or an exchange for the next edition of the festival. Any temporary interruption of the festival after the opening of the festival (e.g. due to bad weather) is deemed to be an interruption of the festival. Any discontinuation of the festival after the opening of the festival (e.g. due to an official ban) is deemed to be a discontinuation of the festival.
  • Changes to these General Terms and Conditions must be made in writing.
  • There are no collateral agreements.
  • The organizer reserves the right to amend these General Terms and Conditions at any time. Amendments shall be deemed to have been accepted unless objected to within 30 days of publication.
  • These General Terms and Conditions shall be governed exclusively by Swiss law, to the exclusion of its conflict of law rules and the Swiss Convention on Contracts for the International Sale of Goods. The exclusive place of jurisdiction for all disputes shall be Frauenfeld, Switzerland.
